My Deceased Mother's will
Hi, there is a lawyer that has the ONLY copy of my mother's will. She doesn't want to give it to me, How can I make her give it to me? I am my mother's ONLY child. My mother is dead.

You can file a probate action and subpoena it. If your mom's estate is worth less than $100k, you can file an Independent Admnistration of Estates Action, and subpoena it. You can have an attorney write a letter demanding that you be given a copy and be allowed to view the original or legal action will follow.

If you are a beneficiary then you would be etitled to a copy. If probate has been open there would be a copy filed at probate court in your county. Contact me directly via my e-mail address.
