Legal Question in Wills and Trusts in California

Defering Benifits form a Annity

My father just passed away -- he has a living trust with some assets that are not listed as part of the trust. The way the trust is written up, that shouldn't matter. One of the Annuity's has my mother listed as a owner and not a beneficiary; becuase of this she can not re-invest the money because she is a owner. (per the terms of the Annuity) The beneifciarys live here in CA and 1 in GA, -- The question is, if we defer receiving the funds, would this bar us from receiving funds from the trust after my mother passes away? We want to to do as she pleases, as this was not only Dads, money but hers also.
