Legal Question in Wills and Trusts in California

How to Determine if Someone is Named a Beneficiary in Another's Will?

A friend (it's true!) wonders whether he may have been named to receive something from a friend of his who passed away a couple of years ago. My friend had never met anyone from the deceased's family and is concerned that, if he was so named in a will, the family of the deceased might have conspired to prevent my friend from receiving whatever may have been left to him by the dearly departed. Is there a statute of limitations pertinent to this issue? How can one inquire about the will of another after he/she has passed away? Would any such will be a public record via probate?

If the estate was over $100,000 in value, it would have been probated in the county where the person died. Check the court records for the probate. If the estate was under that amount, no probate is required, but the declaration process used would still require your friend's signature if he was named in the will.
