Legal Question in Wills and Trusts in California
distribution of assets after death
I am the executor of my mother's will. She just passed away. She lived in a retirement community with very little houshold goods - a few pieces of furniture, clothing. Nothing of material value. I have vacated her apartment and stored her goods at my house. Her will leaves her estate ''equally'' among the children. Nobody wants her furniture or household goods as they all live far away (the few items of a personal nature - books, pictures, etc were distributed after her funeral amongst all the beneficiaries) Can I dispose of/donate items to charity? If so, does the estate take the tax credit for the donation? Or can I assume they are part of my distribution and I can take the tax credit for the charitable donation(since no one else wants them ?) How do I account for the already distributed personal good in the inventory? I am not using an attorney but plan to handle it in pro per, as it's a very small estate (but over $100K, hence probate).
