Legal Question in Wills and Trusts in California

Domestic Partners Rights

My boyfriend and I have been domestic partners for 5yrs. and have no immediate plans to marry, what is the best way to insure ourselves of being able to have say in matters of life and death? If we should need medical treatment.

And how can we be sure that the home that we share and the assets we own will go to the living party should one of us die?

He has grown children from a previous marriage, and I am childless.

Any response would be much appreciated.

You should form a Revocable living trust and a living will.

Re: Domestic Partners Rights

Both of you should have an attorney do an estate plan for you--this would include wills or trust(s), powers of attorney for property and health care, and an agreement regarding your property if you don't already have one. The will or trust directs property at your death, while the powers of attorney allow medical and financial decisions to be made on your behalf by someone you choose.
