Legal Question in Wills and Trusts in California
Donating land from an estate
I wish to donate land from my mother's estate to a non-profit organization. There was no mention of the land in her will, except to say that it could be sold to pay any debts, and there aren't any. I have already had the land appraised and am in the process of changing the title. Can I put the name of the organization down on my change of title request, or must it be changed to my name and then changed over to the organization's? If so, what other forms or fees are involved in donating the land?
Thank You.

This is one of those situations where there are usually two ways to do a transaction and one will result in the higher tax benefit and the other will not. You need to get good advice from an attorney or accountant familiar with taxes and estates before you do any documentation of the transaction.

I'm not a tax expert but I would advise you to check with an accountant to make sure you get the proper tax deduction. it may be that you need to transfer it to your name first to get it.
