Legal Question in Wills and Trusts in California

Am I Due Interest On Money From Estate

My mother passed away in March, 1997. My sister was responsible for dividing her estate up between the three children but held $10,000.00 from each of us in case of any unknown debts, taxes, etc. After several letters and calls she finally sent me my $10,000.00. Since it was almost 7 years she has held this money should there not be some sort of interest paid to me on it?

Absolutely, she just didn't put under the mattress and therefore what ever earnings were earned on that money during that period of time it was held along to the person to which it was to be given. Writer letter to that affect and demand proof of what was earned on the money and you're one-third. Remember in today's market that really won't be that much but it's better in your hands. If she does not respond, or even reasonably respond, have an attorney writer letter making a demand. She has a fiduciary duty and must live up to it. i am at 925-945-6000

Usually bequests do not accrue interest. If she breached her duties as executor or failed to release in a timely fashion you can get interest
