Legal Question in Wills and Trusts in California
durable power of attorney/living will
Can a minor have a durable power of attorney? Or can a minor have a living will? My daughter is facing surgery and wanted to have the durable power of attorney . She is 17. I appreciate your help in this matter.

She has to be eighteen to have either a durable power of attorney for health care or a living will. However, as her mother, you will make the medical decisions for her. (This statement does not constitute my representation of you, nor is it an attorney-client communication.)
