Legal Question in Wills and Trusts in California

I believe I am entitled to an intestate share of my grandfather's home. He died 3 months ago without a will. He had 3 children who predeceased him (one of which was my mother)and 4 living children. 2 of the living children want to sell the home and split the money only between the 4 living children. How can I file a claim to receive my mother's share of the home? Thank you

Yes you are entitled to a share of your grandfather's estate. You could being the probate of your grandfather's will naming yourself as one of the entitled heirs, or if one of the other members files a petition for probate and leave you out of the named inheritors of a share of the estate, you would want to file a Creditors claim immediately or a petition for heirship to have you included in the estate distribution. Obtain the services of a good probate litigation lawyer to represent you immediately. Do not delay, as the time for which certain documents must be filed may be limited.
