Legal Question in Wills and Trusts in California

estate of alzheimers person

My 90 year old mother is unable to make financial decisions. No one has a power of attorney. She has maturing annuities that require instructions for payment options. What can we do?

Re: estate of alzheimers person

unless she is still legally competent (to execute a power of attorney, advance health care directive, will and revocable trust [if needed]), a petition to superior court to appoint a conservator (or conservators) of her person and estate will likely be necessary. you should consult a qualified attorney in the county in which she resides.

Re: estate of alzheimers person

It looks like she needs to have a conservator appointed by a court to handle her financial affairs. In order to do so a petition will have to be filed with the court.

You should find a local attorney to do the petition and appear for you.

Let me know if you are in Southern California and I can help.
