Legal Question in Wills and Trusts in California

estate law

As an heir and trustee of my sisters estate, I am asking for full disclosure of accountability for taxes,1041 and 706, bank accounts and statements only to be denied by the executor.

Am I entitled thru the Freedom of Information Act since my sister passed away nearly four years ago?

Just this morning I received another check with no accountablity

as to where it came from.

Do California laws entitle me to gain knowledge thru the FOI?

Re: estate law

Not FOIA. Have a California lawyer write the lawyer a letter, and if that doesn't work, go to court.

Re: estate law

You are entitled to an accounting, (but not through the FOIA)

Re: estate law

As a beneficiary of the trust you are entitled to an accounting (NOT through FOIA, but rather California Probate Code). If the trustee has failed to provide one despite your request(s) you should contact a local, California, attorney to write a letter on your behalf and obtain a court order for an accounting and/or removal of trustee if the trustee refuses.

Re: estate law

I don't understand your question at all. It implies that your sister had a trust and that you are trustee. But, it also implies that your sister's estate is in Probate. If you don't have a lawyer to assist you, get one. The FOIA has nothing to do with this.
