Legal Question in Wills and Trusts in California
estate trust
My grandparents both passed away and left their estates to my Mother and her 3 sibilings. In January 2009 my Mother passed away but left no will just verbal instructions. What happens to her share of the Trust? Does California pass her portion of the Trust to her issues?

Re: estate trust
First and foremost, I am sorry to hear of your mother's passing. I am also sorry to hear that there may be some family discord because of her passing.
To answer your question, it depends on the terms of the trust. Normally, it would pass to her issue, but the trust may state differently, so it needs to be reviewed by an attorney.

Re: estate trust
This will likely depend upon the terms of the Trust. For instance, does the Trust provide that your mother was to be supported during her lifetime but give the remainder of property to someone else? Or, does the trust simply make your mother one of the four beneficiaries?
You should consult with an attorney to review the trust documents to see what applies.
Let me know if you would like to discuss this matter.
