Legal Question in Wills and Trusts in California
Estates and Wills
My mom passed away and then
shortly after my grandfather did.
When my Grandfather passed away
he left a will and left his home to my
Aunt and my mother. Seeing that
my mother passed as well does her
portion of the home go to her
siblings? There is 3 of us.

Re: Estates and Wills
I am very sorry for your losses. Since your mom died before your grandfather the distribution would depend on what your grandfather's will says. Most likely you and your brothers/sisters would take your mom's share of grandfather's estate. However, without seeing the will it is impossible to say for sure. Please contact me if you would like to discuss your case in more details. -John
Re: Estates and Wills
Your mother's share could very well go to you and your siblings. You won't no for sure until you read the will. You could ask your aunt for a copy of the will or you could wait for notice of hearing from the probate court. If you're not mentioned in the will, however, you will not receive notice. The best thing you can do is carefully approach your aunt and request a copy of the will. If you'd like my assistance call.
Sincerely,

Re: Estates and Wills
It would depend on whether your mother had any testamentary devices, like a will or trust. You may share the half equally, you may get nothing.
