Legal Question in Wills and Trusts in California

Evictions

My life partner of 16 years died 6 months ago without leaving a will. I am contesting the probate for a share of the estate. His brother is the executor. He is trying to evict me and my 8 year old son. His attorneys say that I only have 3 days to move out. Is there anyway to stop this action or get more time to find new housing? The rent market in San Francisco is saturated and it is impossible to find a new place and move in the 3 days. Pleas help me.

Re: Evictions

I really don't understand. You do have certain rights when a spouse dies intestate. Don't you have an attorney representing you in the probate contest? You own at least 1/3rd of everything owned separately and probably more through your community property interest. If you don't have an attorney you should get one.
