Legal Question in Wills and Trusts in California

Execution of Codicil

I am a resident of California. I am currently in central Mexico for a few months, and I want to execute a codicil to my will. Will my codicil be valid in California if I execute it with witnesses while outside of California, i.e., if it is executed in Mexico or another U.S. state? Thank you.

Re: Execution of Codicil

It depends on the terms of the will. Normally, I would recommend that you have more than just a will because a will will not prevent Probate, which is costly and takes quite a bit of time.

Perhaps it would be best if, when you return to CA, we set up a meeting for a free consultation where we can go over exactly what your intentions are and the best means to accommodate them; while avoiding as much tax liability as possible.

I can be reached at the email address listed by LawGuru or through our firm's website located at PasadenaEstatePlanning.com. Additionally, you can learn more about the differences between wills and trusts on our firm's other site No-Probate.com.
