Executor of the Estate
We have an attorney who is also the exectuor of my parents estate. It has been over one year now since my parents have exprired and he still has not settled the estate. The estate is less than one million dollars. What is frustrating is that the lawyer refuses to return my phone calls or give me any indication as to what he is doing or how long it is going to take for him to settle this affair. Is there any way I can have him removed as executor. If so what steps do I need to take and do I still need to pay him for the time he has spent so far?

There are a number of things that can be done to move the matter along. You should file a Request for Special Notice with the court, for starters. Then it must be determined whether the executor is being negligent or not. You may want to demand an accounting.
