Legal Question in Wills and Trusts in California

Co Executor Issues

My grandmother passed away almost

2 months ago. She left a will that

was written with an attorney that

names two executors. Executor #1

recently hired her own attorney to

represent her. The attorney that had

written the will has now stepped

down from his position of

representing both executors and the

estate. I'm not sure why the estate's

lawyer stepped down just because

Executor #1 lawyered up. Why did

this happen? And what does this

mean for Executor #2 that now has

no representation? I am the

deceased's only surviving blood

relative and I am concerned that

Executor #1 is not upholding the

wishes of my grandmother. Your

responses are much appreciated!

Re: Co Executor Issues

The estate attorney stepped down because there was an issue that made them unable to represent all parties. This would mean that there is some form of discrepancy between the executors.

I suggest executor #2 retain counsel and you may want to as well. Do you have a copy of the will? Does it discuss the removal of executors? Replacement executors?
