Legal Question in Wills and Trusts in California
executor responsibilities
I have been asked to be the executor of my uncle's estate. My husband is concerned about whether we could be financially responsible for any debts of my uncle. He is very ill and I want to honor his wishes but I am nervous about this also. My uncle lives in Sacramento, Ca and I live in South Carolina. I know that he was involved in a foreclosure. How can I protect myself financially? What role will I play as the executor of his will and trust for his son?

Re: executor responsibilities
Your uncle's estate is responsible for his debts. You, however, as executor, would have a fiduciary duty to make sure that the estate is handled in the best interests of the estate and its beneficiaries.
If you accept, you would probably want to retain counsel in California to assist you with your duties.
