Legal Question in Wills and Trusts in California

Executor of Trust ???

After both my grandparents passed I recieved a copy of the last will and testement and a copy of the family Trust . not sure if it is irrevecable or not ? Can an executor of said trust change the primary benefituary and make herself the new one and /or can she cash out and open a New Trust Account ? Why would I recieve a copy of trust if I don't not get anything from it??

Re: Executor of Trust ???

You recieved a copy of the trust because you are either a beneficiary, trustee, or because you are a direct heir with claims to the estate. The trustee is generally allowed to move bank accounts and manage funds. If both of your grandparents passed away, and this trust relates to them, then most likely it does not matter if the trust was revocable or not (most likely it was revocable, but now is not).

As far as changing the beneficiary after someone has died.... that is highly abnormal. Generally you need to get all beneficiaries, trustees and named trustees to sign off on a change of beneficiary after the person has died. Are you sure that is what has occured?
