Legal Question in Wills and Trusts in California

executor of a will

my father in law has named his new girlfriend executor of his will.

My husband and his brother are to get 13 each. My father in law is 82 and in poor health. His girlfriend is 60 and has now gotten him to sign over his checking account to her for funds.Right now there is $20,000 in his account. Is there a way to monitor this account, because we have reason to believe she is taking money from him.The sons do not want to make any trouble but would like to know if they have any legal basis to question her actions.

Re: executor of a will

If you suspect that there is undue influence you need to seek a conservatorship, however be careful, if he is not incompetent or not under undue influence, it will cut off any communication because he'll be irritated with you.
