Legal Question in Wills and Trusts in California

Executrix refuses to communicate or disburse

My mother, a resident of Shingle Springs, Ca; El Dorado county, passed away in August of 1998. She left a will naming my sister a resident of Placerville Ca. as her executor. My mothers instructions were that her assets be equally divided between myself, my sister, and my step-brother. My sister has promised that neither I nor my step-brother will ever see our inheritance. My mothers house has been sold, her property appropriated and disposed of, and her accounts emptied and closed by my sister. Every attempt at communication has been rebuffed and she has threatened to have me arrested if I go to her home.

I am currently disabled and cannot afford an attorney. I have no idea which state agency or program might help me.

Please advise.

Re: Executrix refuses to communicate or disburse

I would need to know more--were your mother's instructions in a will or trust? How was the real estate and other property titled? Was probate opened?

If the assets were in joint tenancy, the will does not affect joint tenancy assets--these go directly to the surviving joint tenants.

You might try calling a local attorney--they may not charge for the first meeting and should be able to answer your questions if they have more facts.
