Can we as a Family declare our deceased Bother's Son incompetant? Our Brother died and his Son is not doing anything to help bury his Father.

I'm not sure what you mean by "help bury his father." If his father's body remains at home, certainly a call to the Health Board would be appropriate. If you mean that he refuses to pay for the funeral, then there are other ways to deal with it -- such as you and the rest of the family chip in for the funeral, and then trying to collect from your nephew. In times of grief, people sometimes act irrationally.
