Legal Question in Wills and Trusts in California

How can our family get my Grandfathers Power of Attorney revoked ?

My grandpa's nephew supposedly has Power of Attorney over him. He has moved him out of his home and in with my Aunt. He has all grandpas belongings in a storage, has his checkbook, and has his living trust at his home. My grandpa never has money in his pocket and when he asks his nephew for some, he says he dosent have any, but he should have alot since he is not paying houehold bills. We feel he is being financially abused and mentally because grandpa is scared of him. Also, we feel like he has altered the living trust by either manipulating grandpa or with it being unknown, how can we find out where his money is going and if the living trust is written the way it is supposed to be ? There is 7 grandkids and 3 greats that want this man revoked.

Higher an atorney to see about getting a conservator appointed. The conservator then can step into the shoes of the grandfather and revoke the POA. A cheaper way is to convince grandpa to revoke it himself if he is capable of doing so. If not the conservatorship would work.

You need to hire an attorney to file the appropriate papers so a conservator of your grandfather's estate can be appointed. If your grandfather is scared of the nephew than he probably will not revoke the power of attorney himself. If you need help getting your grandfather away from this man I can speak with you free of charge and help you figure out what to do. There shouldn't be a problem with having a conservator appointed since the nephew is obviously not acting in the best interests of your grandfather. I can be reached at 877-546-9918. If your grandfather passes away before the proceedings are concluded than the will can be contested if it has been changed because of influence by the nephew. Once a conservator is appointed an accounting of the estate can be done so that you know if the nephew has been stealing money.
