Legal Question in Wills and Trusts in California
family trust and debt
My sister just passed away and she had a trust with her 23 and 26 yrs old as beneficiaries. there is about $300K from the house once it is sold. however there are alot of hospital bills and credit cards. are the kidds responsible for my sister's debts? can they put a judgment against the trust? are all these money must be paid in full?

Re: family trust and debt
The successor trustee of the trust is required first, before distribution of trust assets, to pay the just debts of the decedent. These bills can and should be negotiated to help preserve trust assets.
