Legal Question in Wills and Trusts in California

Father, daughter joint property

Father, mother and daughter (only child) were joint tenants in family home and income property. Mother passed, now father has remarried. The father was going to sign premaital agreement but didn't. If father passes will daughter have to share community property with new wife or does she have survivorship rights to orginal mother and father's property.

Re: Father, daughter joint property

if the property was paid for before the marriage the daughter will likely get it free and clear. If mortgage paymnts were made during the marriage the wife might be entitled to a small amount based on the amount of her community property that went into the porperty.
