Legal Question in Wills and Trusts in California

My father died without a will. He had a car that was only in his name. His wife told me I had to wait 40 days before she would give me the car. What can I do to get the car in my name?

You have left out too much for us to be able to answer. Was the car his personal property or community property [just because only his name was on title does not mean it was not community property], why is she giving you the car and why can you apparently not wait or are you willing to wait and just want to knowing about transferring title?

If she is acquiring title to the vehicle through small estate affidavit, it is true that 40 days must first elapse. But, why should she give you the car?
