There is a petition that is filed with the Court, notices that have to be made.

The Petition is called "A Petition to Establish Record of Death". As Mr. Selik has stated, the petition is filed with the approriate court. Certain procedural requirements, including notices, must be met. A declaration by the petitioning party and any witnesses must also be filed with the court. The petition will also require a hearing.
