Legal Question in Wills and Trusts in California
My father passed away in California last summer. My sister flew out there and took care of the arrangements. He had a military funeral. Anyway, my sister told me that she had papers for me to sign and that she would mail them to me. I never received them. She also told me that she had a check for me, I think from the life insurance, but she never sent it. I asked her about the check when I saw her on Christmas and she said that she forgot the check and would send it to me but she never did. I don't trust my sister because she has forged my name in the past. I'm thinking that she somehow took the money that belongs to me. I'd like to contact the insurance company myself to find out how much I'm owed but I don't know which insurance he had. I called the probate office in Los Angeles but they didn't have a record of him in the probate office so I'm guessing his affairs aren't being handled through probate. Does anyone know who I can contact in California or the court system to find out any type of information about my father and what I'm owed.

If no probate case was opened, then the court system would have no information. Try seeing if there are any cases that have been filed involving your father, sister, or you.
You have to demand of your sister that she provide you with the check and all the information you want. if the valid of your father's assets are greater than $100,000 probate must be filed for. Anyone can do so. If your sister refuses to co-operate, you might have to file suit against her and the take her deposition to know what she claims. Check with his employer if they might know something about company life insurance, ask his friends if they know anything about assets, attorneys who represented him, etc.
