Legal Question in Wills and Trusts in California

My father-inlaw passed away and my sister-inlaw is trustee.

My sister-inlaw has not provided us with a list of assets and only partial papers of the trust. We need to get all of the documents before we have an attorney look it over to say how we should proceed. How should I obtain the missing papers from Siskiyou Ca.?

If she is the successor trustee of the trust, which is probably now irrevocable, she has a duty to provide you with a copy of the trust and an accounting of the assets of the trust.

If she does not provide that information, you may need to file suit to obtain it.

If this is a trust, the trustee owes you a copy of the trust and information regarding the administration of it (including assets and liabilities) upon your written request. If the trustee refuses, or gives partial information, an attorney letter usually works. If it doesn't, you may need to go to court to force the issue.

If this is in probate court, the information should be in the court file--copies are available from the court clerk--contact the court clerk to see how to get these.
