Legal Question in Wills and Trusts in California
father's estate
My father died a few years ago and my siblings and I did not receive a dime. He remarried 5 years prior to dying. I believe he left everything to her. She has since then remarried. She told me that when she dies, we are in the will. Since she is remarried, do you think anything will be passed on to us? Where should we look to find anything? My father inherited quite a bit of money and some of it was tied up into their estate.

Re: father's estate
If she doesn't do any estate planning, then you may be out of luck. Keep in mind that a will is helpful (if you are indeed named as a beneficiary). However, if she and the new husband own everything in Joint Tenancy, that "trumps" the will and all will go to the husband when she dies. Typically, he will have his own heirs in mind...and not you. The best way for her to protect you is to create a living trust and "fund it." If you need help, let me know.
