Legal Question in Wills and Trusts in California

Father's estate

My father recently passed away. My brother was caring for him and has taken control of his estate. He will not tell me if my father had a will or anything about the estate. He told me that everything My brother is mentally unstable and I am certain he will not be truthful. What are my rights in this matter? How do I find out if my father had a will? How can I find out how much my father's estate was worth? SHould I file for probate?

Please help!

You need to act right away before assets disappear. You have the right to a copy of the will or trust, if you don't get either, then you might want to open probate. Contact my office for assistance.

yes, you should immediately retain a qualified attorney who can advise you and if necessary file a petition for probate in the the superior court in the county in which your father lived.
