Legal Question in Wills and Trusts in California

Right To My Father's Truck

I need to know what document needs to be filed with the court to force a friend of the family to turn over whereabouts of my deceased father's truck? He is holding the truck and not telling me where it is because my dad owed him money before he died and he supposedly signed the truck over to him, however, I own the truck because my Dad defaulted on the loan with the bank and I had to settle it to get title to the truck, my Dad never owned the truck to sign it over anyway. My father had no will and I am his only child, this is all I have left of him, I have received no money or anything else from all of this, all I have left is the truck which I paid for, what needs to be filed with the court?

You need to file for letters of administration as personal representative of the estate in a probate proceeding. They you will have the power to get a court order regarding collecting your father's property and settling the estate.
