Legal Question in Wills and Trusts in California

Fathers will

My father died in 1985, he left when I was a baby and I never saw or met him. Recently I obtained a copy of his will. He remarried and left his estate to his wife and some money to a friend and then upon his wifes death or in the event she dies or can't fullfill the will it goes to a college he attended. It states in his will that I am to get nothing. I know this sounds horrible but am I entitled to anything or can I contest this will. I believe his wife is still living. He never paid my mother any child support or tried to contact me and I feel I deserve something since my mother struggled for so many years. I live in Illinois and my father died in California and that is where the will was registered in probate.

Re: Fathers will

Sorry. You are cut out. If you had presented a claim for unpaid child support in 1985, perhaps you might have had a case. If you appeared in the probate and litigated the legitimacy of the will, you might have prevailed if you were able to prove it had been executed under duress or undue influence, or when he was not competent mentally to make a will. But, that's way too late now.
