Legal Question in Wills and Trusts in California

Father's Will

It has been 12 yrs since dad died and I just found out that there is a Will. My step-sister who was left as Executor has it and says she will not show the Will until my mother dies Can she get into trouble for this, also how can we find out if she even recorded the Will? Would like to know exactly what my father's last wishes were.

Re: Father's Will

you have the right to open probate on your father's estate. do it right now. contact an attorney near where your father lived. your step-mother does not get all of your father's assets. you can open probate without a will. if your step-sister has a will she will give you a copy--trust me. if she doesn't your attorney can cite her to appear with the documents.

Check your county recorder's office to see if there is any real property still in your Dad's name, and if that property is held as joint tenancy or as community property with your mother. A court proceeding may be necessary to remove your Dad's name from the title.
