Legal Question in Wills and Trusts in California

What needs to be filed Sister death Ca Feb 2003

Sister died CA w/will naming 50/50 to sister in AL & OR - Sister in AL executor & not giving OR sister any info. How do I find out if will was ever filed? House was sold while CA sister still alive via power of attorney held by AL sister but still approx 7000 still held in escrow which needs to be claimed. Also 2 insurance policies pending distribution to estate but need form of small estate affidavit for CA & death certificate. 2 Policy face value 500 ea gaining interest now approx value 7000 total. Furnishings, personal items etc shipped to AL & used dead sisters credit cds. What also happens to Medi-cal bills & credit card bills? My Only interest is getting insurance policies handled for 50% so what do I need to do or file? Thanks for your help!

Re: What needs to be filed Sister death Ca Feb 2003

Assuming your CA sister's real property was less than $20,000 and personal property was less than $100,000 at the time of her death, your CA sister's will may not need to be filed in a court probate proceeding. Debts of your CA sister need to be paid from the property she left at the time of death before anything can be distributed to her heirs. As a named heir, you can insist that your AL sister disclose to you a listing of estate property and debts. From your description, it sounds like there is very little remaining in the estate, but you could contact and pay an attorney to seek your AL sister's compliance with her duties as an executor and agent for your CA sister. You should seek an legal advice in the location where your CA sister lived before she died.
