Can a brother who's sister dies and

leaves two small children and doesn't

leave a will, clean out her savings and

checking account because he's a signer

on them, legally?

No he's not permitted to take any of "her" assets.

Perhaps. I depends upon whether the funds in the account were intended to belong to him as well. The bank,though, will pay the funds to him unless a court issues an order preventing distribution until the issues are resolve.
