Legal Question in Wills and Trusts in California

Greetings, how do I find out if my dad (who is deceased) drafted a will, and how do I find the same for my mom (who is still alive and 79) did the same? If mom has NOT had one done, then she'd like to do it before she passes. She can't remember if she did or not. She's having memory issues. I think she did, because about 6 years ago when she was a bit sharper (she's still lucid), she was adamant about getting hers and dad's will done and I seem to remember them going to have it done. Thanks so much in advance.

Unless you find the will among your mother's papers or can figure out the name of the attorney that they hired, it will be difficult to find her will (assuming she made one). Since your mother is still lucid, she should meet with an attorney to review how assets are held and how to best transfer those assets upon her death. For example, a new will would revoke all prior wills.

I agree with Aaron, unless you know who drafted the will or can find it in her papers or maybe in her safety deposit box, she should have a new will drafted.

I suggest contacting and Estates and Trusts Attorney to draft a new will for your mother.
