How can I find out if my deceased Father had a Will or Trust ?

Do we just assume you have already looked through his home and did not find it? If he owned a home, you can search the public records to see how title is held to the property. It if is in a trust, it will be reflected in the deed. If he did a will and someone has it, then it is supposed to be filed with the Clerk's office in the county where he lived. If you think he DID do one, you can try contacting his attorney or any record of an attorney he saw during his life. Even if he did not do one, depending on whether or not real property is involved, you may need to open a Probate and proceed as if he were intestate..
