Legal Question in Wills and Trusts in California

How to find out if a deceased left a will, trust?

How can a parent of a disabled adult find out if her father who was remarried and died has left a will or has a trust, without having to ask the deceased father's current family about this? Can a surviving parent of an adult off-spring, who became disabled as a juvenile, but a Family Law Court ruled that the father no longer had to support his disabled daughter once she became an adult, petition a court for a portion of the deceased father's assets, if nothing was left to the disabled adult daughter? Does the disabled adult daughter, as the only live off-spring of the deceased father, have the right to know what happens to her father's estate?

Other than contacting the father's attorney, if he had one and you knew who the attorney was, you can go to the superior court in the county where he lived to see if a petition for probate was filed. If a petition was filed, your daughter may receive a portion of his estate through intestacy succession.
