Legal Question in Wills and Trusts in California
How do I find my will?
Simple question really, I hear all my life from several credible witnesses that I was to recieve some sort of will.I speculate for some unknown reason my mother is hiding it from me, for she is THE ONLY one I don't recieve a straight answer from.So in a nutshell I want to find out if I have something to move forward with.So if there is someone out there to assist with this it could be a good thing for both of us.PS my mom is a SHARK so I will need an attourney. Thank you for reading my request.

If one makes a will, it is made by that person. If you have a will, you will have had to make a will. If you mean you want to find out if you stand to inherit or have inherited under a will, that is a different matter. If the person from whom you expect to inherit is not dead, the will is merely an intention and has no legal force unless and until that person dies. If the person from whom you suspect you have inherited or stood to inherit is dead, you can check with the Probate Clerk in the court in the county in which that person last resided before death to see if a will was probated. If so, you will find a copy in the file.

you mother doesn't have to give you anything from her estate. with that in mind, i really don't understand your question.
Re: How do I find my will?
Are you talking about a will that YOU created? If so you can simply void that will (supersede it) with a new one that revokes any prior will.
If you are talking about a will that someone else prepared before their death and you believe that you are entitled to receive an inheritance, there are several potential ways to try to get it.
If, however, that person is still living, then you generally have no right to receive a will from that person before their death.
