Legal Question in Wills and Trusts in California

finding if a company is a corporation to sue

I took this company to small claims court sueing an individual as a sole proprietor and won my judgement by default because he didn't show up. The person wrote a letter to cancel the judgement claiming the company is a corporation. I live in california and searched under the secretary of state to find if this company is a corporation, and it isn't listed. How do I verify if this company is a corporation so I know who to sue or how do I know if I am correct in assuming that this company is a sole proprietorship?

Re: finding if a company is a corporation to sue

All corporations licensed to do business in the state of California must be registered with the secretary of state, or else they may not be listed as a valid corporation. You may also sue individual officers or principals of a company and/or corporation. You should retain legal assistance here to review your case and properly remedy the situation for you thereafter. Our Law Firm can affordably assist you here.
