Legal Question in Wills and Trusts in California

Grandchild as Attorney-in-fact

My grandmother appointed me as an Attorney-in-fact when I was relatively young (early 20s). She has always sent money for Christmas and birthday gifts to her grandchildren. Can she legally still give gifts of money to me, who has Durable Power of Attorney?

Re: Grandchild as Attorney-in-fact

Yes. You cannot give gifts to yourself as her attorney in fact, unless the Power of Attorney document authorizes that you can.
