Legal Question in Wills and Trusts in California

My grandfather recently passed away, leaving me a gift of $50,000 that he had set up in a Living Trust Fund. The gift is to be distributed prior to the distribution of the estate.

My greedy aunt is the executor of the trust and she has told me(and her attorney) that they are going to let the court decide my entitlement to the distribution or if there should be any offsets. What does that mean? Are they trying to take a part of my inheritance away from me?

Any advice would be helpful.

Thank you

Bill

If they haven't commenced a court proceeding, you might first write a letter demanding an accounting. If the statutory time passes without one, then you can file a court proceeding for an accounting, distribution, and seek attorney's fees.
