Legal Question in Wills and Trusts in California

My Grandfathers death 1/30/03

My Grandmother died in early 1999 and had a very large doll collection. She added to this collection by picking up dolls from each of her Grandaughters as we grew up. Each doll was labled with the name of person she got it from. My Mother Died back in 1993 and I guess my Aunt and Uncle feel that since my Mother is no longer alive my 2 brothers and I are not going to recieve anything from our Grandparents estate. Now my Grandfather has also died January 30th 2003 and I want a copy of his will. I have been able to find out that there are 2 probate courts close to his home in Fontana CA. Where and how would I contact the court to request a copy. What if my Aunt does not file his will with the probate court?

Write to the Clerk of Court for each of the probate courts you have located. Provide them with the name and date of death for your grandfather.

If there is no will filed for probate, they will have no record.

It is not so unusual for grandchildren to take nothing from a grandparent's estate if there was no surviving parent. The will can provide that the estate will be distributed only to the surviving children without passing to any of the issue of a child does not survive. You can obtain telephone numbers and other information for the Fontana and other probate courts for San Bernardino County, California at this website:

http://www.co.san-bernardino.ca.us/courts/probate/probate_info.htm Information about probate filings should be accessible through the court clerk by fax or mail--call the listed numbers and ask. The will would have to be filed in a court with jurisdiction--generally the court where the decedent resided--in California. If no will is submitted to probate, you could possibly file a proceeding. Be certain to check with an attorney in the County to review your situation.
