Legal Question in Wills and Trusts in California

Grandmother died

My daughter just found out a month ago that her grandmother had died july 2000. We were very close after my wife died and GM helped me raise my daughter until she could not see to live by herself. The GM's daughter my sister in law decided it best for her to move with her summer1997. LOng story short GM died and no one told us about it. We thought she was still alive. GM left savings bonds and some papers for my daughter but they refuse to give to her.How can we get these and find out if there was a will with my daughter In it. Something is very fishy.

Re: Grandmother died

Generally, there must be a probate, with or without a will. If there are documents that indicated that your daughter was to receive something, they must be produced.

Otherwise, the estate goes by intestate succession, which is regulated by statute, and depends on next of kin.

You probably need some help to uncover the facts.

Re: Grandmother died

I believe you should file a petition for probate depending on dollar values, documents you have, etc.... By zip code it looks like you are in the "Friendly City." I went to college at SSU so am a big fan of your area! If the probate is in Sonoma County or other county in NorCal I would love to help. I am in Sacramento. Good luck!!

Ken's answer is a good one. Ultimately you will have to file a petition for a probate if diplomacy fails.
