Legal Question in Wills and Trusts in California

How do I become my grandmothers Conservator?

My grandmother lives in San Francisco. I live in San Diego. I did not grow up around my grandmother. Because of a variety of things my sister did to my grandmother plus the fact that she became blind after an operation. (She won a malpractice suit)she had to sell the house and is living in an assissted care facility. She was appointed a conservator by the state. I was not made aware of any of these things until recently. A false address was given for me to the conservator. She had over $250,000.00 4 to 5 years ago and now she only has about $125,000.00 due to her having to pay for her living arrangements, at a cost of $3,000-$4,000 per month. I feel that her money should be invested to help it grow, and also, I am thinking that possibly she can come and live with me and my family where I can have someone come in and help her. With her money growing it can be there for a later date when she really needs full serious care. She has no medical problems other than her blindness. What can I do? Can I become her guardian? Conservator? or what?

Is you grandmother of sound mind? In order to take over your grandmother's estate you have to show that it is in her best interest and that she can not take care of her own estate in her present condition. I would need additional information in order to give you sound legal advice. Please email me with your reasons why your grandmother is no longer able to care for her own affairs.

Sincerely,

John Hayes
