Legal Question in Wills and Trusts in California

A guardianship was granted based on false admissions.

My sister filed a Petition of Guardianship without my knowledge or permission. At the time the Petition was filed, my daughter was not in her custody or in the County where the Petition was filed. The Petition was granted based on her false admissions. I have since objected to the Petition and filed a Petition to Terminate the Guardianship. My sister has also threatened to adopt my daughter. Can the Guardianship be set aside based on fraud? How do I get the Court to issue Citations? Which way would be the best and quickest way to get custody of my daughter?

Re: A guardianship was granted based on false admissions.

There is no "easy" way to unravel your problem. The manner in which you must proceed will depend on which county and in which Court your sister filed her guardianship papers. Our firm has successfully set aside the type of guardianship your sister has established, and can probably help you, but more facts are needed. Please feel free to e-mail us at [email protected].
