Legal Question in Wills and Trusts in California
Heggstead petition
My sister is the executor on my mom's living trust. My mother signed her trust two weeks before she passed so the trust was never recorded throught the court. Trying to pay off her reverse morgage the lender informed us that we need this petition. Can a paralegal do this for us? Or can we do it ourselves?

Though you could try to do it yourself or with the aid of a paralegal I think you would have a hard time being successful. A Heggstad petition is a fairly complex matter and I would advise you to hire an attorney who does a lot of these (like me). Your total fees/costs should be between $2,000 and $3,000 depending on the details of your case. My firm does probate work throughout the state of California and would be happy to give you a free phone consultation if you mention Lawguru.com. I advise you to find a firm like mine that is very familiar with this type of petition. Good luck.

A paralegal is not authorized to practice law. You have legal issues that an attorney will need to counsel you about. Call me directly at 1.619.222.3504.
