Heir dies before distribution
I am one of 3 children and also the executrix to my moms estate, My oldest brother just died before we went to court for the distribution to be oked. Does the portion of my deceased brother revert back to my moms estate? His will disinherits 2 of his 4 kids and goes to strangers. I Hate the thought of giving my moms hard earned money to someone who does not deserve it. Any advice would be appreciated.

It really depends on timing and the terms of the will. You need to find competent counsel in your county. If you are are in Marin or Sonoma Counties, feel free to contact me.

Without looking at the documents, my first reaction would be that the funds belong in his estate, and can be distributed accordingly. If your mother has a will, or had a trust, it may dictate differently.
