Legal Question in Wills and Trusts in California
I am an heir to a living trust to receive 50,000. I was paid 1/3 of that almost 3 years ago. There is a farm that needs to be sold and I understand the executors have put this up for sale, however, I believe they are hidding something. The reason I say this is because I have requested information as, where is this property located and who has listed it. Unfortunately, they will not give that information. My question is, what rights as an heir do I have regarding this information?

As a beneficiary you have a right to reasonable information respecting your bequest. If the Trustees will not provide you with that information, or if you believe that they are not properly discharging their duties as trustees, you can petition the Court in the County in which the Trust is being administered to instruct the Trustees to provide that information and/or take other steps as may be appropriate. I hope this helps.
IMPORTANT NOTICE: The above response is not intended to, and does not, create an attorney-client, fiduciary or other confidential relationship with the responder. Neither does it constitute the providing of legal advice or services or the giving of a legal opinion by the responder. Such a relationship can only be created, and legal advice and/or legal services provided, pursuant to a written agreement with the responder. Accordingly, no obligations of any kind are assumed with respect to any matter or question presented. It should also be noted that legal issues are often time sensitive and legal rights may be lost or compromised if you do not act in a timely fashion.
I suggest that you have an attorney review the terms of the trust and contact the trustees on your behalf.
